Terms of Service

These Terms of Service ("Terms") govern access to and use of Personalizer OS, including the admin dashboard, APIs, rendering services, and related integrations (collectively, the "Service") operated by Custom Fabrica ("we", "us", or "our").

1. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Internal admin accounts may require two-factor authentication. You agree to provide accurate registration information and to notify us promptly of unauthorized access.

2. Acceptable use

You agree not to misuse the Service. Prohibited activities include, without limitation:

  • Uploading unlawful, infringing, or harmful content
  • Attempting to bypass usage limits, security controls, or billing restrictions
  • Reverse engineering or interfering with platform infrastructure
  • Reselling access to the Service without written authorization

3. Subscriptions and billing

Paid plans, included render quotas, and overage charges are described at signup or in your plan settings. Unless otherwise stated, subscriptions renew automatically. Failure to pay may result in suspension of access.

4. Customer content

You retain ownership of artwork, assets, and store data you upload. You grant us a limited license to host, process, render, and transmit that content solely to operate the Service and fulfill orders connected to your stores.

5. Availability and support

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and force majeure events may affect availability.

6. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, non-payment, or security risk. Provisions that by nature should survive termination will survive.

9. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance.
